1. General

1.1 The domain six-seasons.in (the "Platform") is owned, managed and operated by Kalivera Healthcare Private Limited, incorporated under the Companies Act, 2013, with registered office at Awfis, 6th Floor, N Heights, Plot No 38, Phase 2 Hitec City, Siddiq Nagar, Hyderabad — Telangana, 500081, India (hereinafter referred to as "Six Seasons", "We", "Us", or "Our").

1.2 "You", "Your", or "User" means any person who visits, browses, uses or accesses the Platform or avails any Services on the Platform, including persons who purchase Products by placing an order.

1.3 Six Seasons is a technology platform that enables and facilitates the online sale and purchase of sexual wellness products ("Products") by Users. The facilitation of the sale and purchase in accordance with the terms herein is collectively referred to as "Services".

1.4 These Terms, read with the Privacy Policy and any other specific terms, constitute the entire legally binding agreement between you and Six Seasons. Please read them carefully before using the Platform.

1.5 If you do not agree with these Terms, please refrain from using and accessing the Platform, registering on the Platform, and availing any Services.

1.6 By using the Platform or availing any Services, you are deemed to have agreed to these Terms and all policies of Six Seasons.

1.7 – 1.8 Six Seasons reserves the right to change, modify, amend or update these Terms at its discretion. Your continued use of the Platform shall be deemed to signify acceptance of any amended provisions.

2. Creating an Account

2.1 – 2.3 To access certain features, you may be required to create an Account by completing a Sign-up process. To create an Account, you must provide personal information including name, User ID, gender, country, ZIP/postal code, age, phone number, and password. By signing up, you agree to all Terms and policies.

2.4 Six Seasons shall not be liable for any loss caused by unauthorised use of your Account. You shall indemnify Six Seasons for losses incurred from any unauthorised or fraudulent use of your Account.

2.5 – 2.6 You agree to provide accurate and correct information at all times, and to log out from your Account at the end of each session to ensure complete security.

2.7 – 2.11 You are solely responsible for maintaining the confidentiality of your credentials. You must immediately notify us of any actual or potential unauthorised use of your account. Six Seasons shall not be responsible for liabilities arising from misuse of your Account or password.

3. Privacy

3.1 You agree that during your use of the Platform, you will provide us with certain information and data. We respect the privacy and confidentiality of such data. Our Privacy Policy, available at six-seasons.in/privacy-policy, governs such information. By using the Platform, you agree to the terms of our Privacy Policy.

3.2 – 3.4 We will only collect, use, disclose or process your information in accordance with our Privacy Policy. Six Seasons utilises standard security configurations, which constitute reasonable and sufficient security practice per industry standards and the Information Technology Act, 2000.

4. Conditions to Use Platform

4.1 – 4.2 You must be 18 years of age or older to use or visit the Platform. The Platform can only be used by individuals who can form a valid contract under the Indian Contract Act, 1872. Persons incompetent to contract (including minors and un-discharged insolvents) are not eligible.

4.3 Individuals under 18 may use the Platform only with the involvement and guidance of their parents or legal guardians. We reserve the right to deny access to any person at our absolute discretion.

4.4 – 4.5 You agree to act lawfully and honestly at all times and comply with all applicable laws. You agree not to interfere with, disrupt, or harm the Platform or intercept any system, data or information from the Platform.

4.6 – 4.11 We do not guarantee uninterrupted or error-free access to the Platform. We reserve the right to suspend or discontinue the Platform or any Services at any time without liability. Providing false information may result in indefinite suspension of your account.

5. Code of Conduct

5.1 You agree not to host, display, upload, modify, publish, transmit, update or share any information that:

Infringes intellectual property or privacy rights of any person.
Is false, misleading, or violates any law.
Harasses, harms, or advocates harassment of any person.
Promotes illegal activities or obscene/defamatory content.
Harms minors in any way.
Threatens the unity, integrity, defence, security or sovereignty of India.
Promotes an unauthorised copy of copyrighted works.

5.2 – 5.10 You further agree not to incorporate malicious code on the Platform, impersonate any person, attempt unauthorised access to the Platform or its systems, make defamatory statements about Six Seasons, or use the Platform for any unlawful purpose. The User shall indemnify and hold harmless Six Seasons from any losses arising from breach of these terms.

6. Purchase of Products

6.1 – 6.2 The Platform lists a variety of Products. To purchase, you must have a registered Account and provide accurate information including delivery address and payment details.

6.3 Title in the Products shall be transferred upon dispensation of the Products and raising of the invoice of sale by Six Seasons.

6.4 – 6.5 Listing of Products is merely an invitation to offer, not an offer for sale. Placement of an order constitutes an offer by the User. Six Seasons may accept or decline any order, and reserves the right to discontinue any Product without prior notice.

7. Feedback & Product Reviews

7.1 – 7.3 Registered Users may provide feedback, ratings, and reviews about Products ("Product Review"), which Six Seasons may or may not publish at their sole discretion. The User is solely responsible for the content of their reviews. Reviews must not violate any applicable law, infringe intellectual property or privacy rights, or be offensive on moral, religious, racial or political grounds.

8. User's Content

8.1 Content you upload or post on the Platform will become our property. You grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use such content for any purpose including promotional and advertising purposes in any media now known or hereafter devised. You are not entitled to any payment for such use.

8.2 – 8.3 By posting content, you verify the truthfulness and authenticity of such content. Any content deemed unlawful in any jurisdiction will be removed upon intimation by the relevant authorities.

9. Payment Terms

All payments on the Platform shall be made in INR. Accepted payment methods include Credit/Debit Card, Net Banking, and UPI. All transactions are subject to applicable Indian tax laws. Orders may be cancelled within 24 hours of placement free of charge. Post-dispatch cancellations are subject to the Cancellation Policy.

10. Indemnity

You agree to indemnify, defend and hold harmless Six Seasons and its affiliates, officers, directors, employees, consultants, representatives, shareholders, contractors and agents against any and all losses, liabilities, claims, damages, demands, costs and expenses (including legal fees) arising out of or in connection with:

Any breach or non-performance of any of these Terms.
The truthfulness and correctness of information provided by you.
Any content posted by you on the Platform.
Any third-party claims arising out of your use of the Platform.
Breach of any third-party rights by you.

11. Intellectual Property Rights

All intellectual property rights in all material on the Platform — including text, audio, video, graphical images, interfaces, design, computer code, software, trademarks and logos — are the property of Six Seasons, its parent, affiliates and associates, protected under applicable Indian laws.

Your use of the Platform does not grant you any rights in relation to our intellectual property. You shall not copy, reproduce, download, publish, adapt, create derivative works, broadcast, record, print, commercially exploit, transmit, edit or distribute any intellectual property from this Platform without express prior written consent.

12. Termination

Six Seasons may, at its sole discretion, terminate your access to and use of the Platform at any time, including without limitation if you breach these Terms. We reserve the right to terminate if:

There is a breach of any applicable law or these Terms.
We are unable to verify or authenticate any information you provided.
Your actions may cause legal liability to Six Seasons.
We are required to do so by law.

13. Liability & Disclaimer

In no event shall Six Seasons, or its officers, directors, employees, partners or suppliers be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages, including those resulting from loss of use, data or profits.

In no event shall the total aggregate liability of Six Seasons to any User for all damages, losses and causes of action exceed an aggregate amount of INR 2,500/- (Indian Rupees Two Thousand Five Hundred only).

This Platform is provided "AS IS" and "AS AVAILABLE". Six Seasons makes no representations or warranties of any kind, express or implied, as to the operation of this Platform or the information included on it. Your use of this Platform is at your sole risk.

14. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of India. Courts and tribunals of Hyderabad shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.

If any dispute arises, it shall first be attempted to be resolved through mutual good faith consultations. If unresolved within 45 days of either party sending a notice, the dispute shall be resolved by binding arbitration under the Arbitration & Conciliation Act, 1996, by a sole arbitrator appointed by Six Seasons.

Any complaints, abuse or concerns with regards to content, comments or breach of these Terms shall be immediately informed to:
