The domain name six-seasons.in (the "Platform") is owned, managed and operated by Kalivera Healthcare Private Limited, a private limited company incorporated under the Companies Act, 2013, having its registered office at Awfis, 6th Floor, N Heights, Plot No 38, Phase 2 Hitec City, Siddiq Nagar, Hyderabad — Telangana, 500081, India (hereinafter referred to as "Six Seasons", "We", "Us", or "Our").

Six Seasons is a technology platform that enables and facilitates the online sale and purchase of sexual wellness products ("Products") by Users.

The terms "You", "Your", or "User" mean any person who visits, browses, uses or accesses the Platform or avails any Services on the Platform.

By purchasing Products on the Platform and/or visiting, viewing, accessing or otherwise using any of the Services, you are deemed to have agreed to these Terms and all policies of Six Seasons.

To access certain features you may be required to create an account on the Platform. You will be asked to provide information including name, User ID, gender, country, ZIP/postal code, age, phone number, and a password.

You agree to:

• Provide accurate and correct information at all times.
• Log out from your Account at the end of each session.
• Maintain confidentiality of your account credentials.
• Immediately notify us of any actual or potential unauthorised use of your account.

Six Seasons shall not be liable for any loss caused by any unauthorised use of your Account. You shall indemnify Six Seasons for losses incurred from any unauthorised or fraudulent use of your Account.

During your use of the Platform, you will provide us with certain information and data. We respect the privacy and confidentiality of such data.

We will only collect, use, disclose or process your information in accordance with our Privacy Policy. We may share data with third parties as required and as set out under the Privacy Policy.

Six Seasons utilises standard security configurations for securing data and information on the Platform, which constitutes reasonable and sufficient security practice as per the industry standard and the Information Technology Act, 2000.

You must be 18 years of age or older to use or visit the Platform in any manner. By visiting the Platform or accepting these Terms, you represent and warrant that you meet this age requirement.

The Platform can be accessed only by individuals who can form a valid contract as per the Indian Contract Act, 1872. Persons who are "incompetent to contract" (including minors and un-discharged insolvents) are not eligible.

• You agree to act lawfully, diligently and honestly at all times.
• You will not interfere with, jeopardise, or harm the Platform and/or Services.
• You will not intercept, expropriate, re-use, steal or re-utilise any system, data or information.
• We do not guarantee uninterrupted, secure or error-free access to the Platform at any time.

You agree not to host, display, upload, modify, publish, transmit, update or share any information that:

• Belongs to another person and infringes their intellectual property or privacy rights.
• Is false, misleading, or violates any law for the time being in force.
• Harasses, threatens or harms any individual or group.
• Promotes illegal activities or contains obscene, defamatory or objectionable content.
• Threatens the unity, integrity, defence, security or sovereignty of India.
• Promotes unauthorised copies of copyrighted works.
• Harms minors in any way.

You also agree not to incorporate computer viruses or malicious code on the Platform, impersonate any person or entity, or create liability for Six Seasons.

The Platform lists a variety of sexual wellness Products which Users can purchase. To purchase Products, you must have a registered Account.

• Listing of Products is merely an invitation to offer and not an offer for sale.
• Placement of an order constitutes an offer by the User to purchase, subject to these Terms.
• Six Seasons may accept or decline any order placed by the User.
• Six Seasons reserves the right to discontinue any Product from sale without prior notice.

All payments on the Platform shall be made in INR. We accept the following payment methods:

• Credit / Debit Card
• Net Banking
• UPI

Payments are subject to applicable tax laws of India. You may cancel a purchase order within 24 hours of placing the order. Once the Product has been shipped, cancellation will not be accepted.

All intellectual property rights in all material presented on the Platform — including text, audio, video, graphical images, interfaces, graphics, design, computer code, software, trademarks and logos — are the property of Six Seasons, its parent, affiliates and associates, and are protected under applicable Indian laws.

You shall not copy, reproduce, download, publish, adapt, create derivative works, re-publish, post, broadcast, record, print, commercially exploit, transmit, edit or distribute any intellectual property or content from this Platform without express prior written consent from Six Seasons.

In no event shall Six Seasons, or its officers, directors, employees, partners or suppliers be liable to you or any third party for any special, incidental, indirect, consequential or punitive damages whatsoever, including those resulting from loss of use, data or profits.

In no event shall the total aggregate liability of Six Seasons to any User for all damages, losses and causes of action exceed an aggregate amount of INR 2,500/- (Indian Rupees Two Thousand Five Hundred only).

These Terms shall be governed by the laws of India. Courts and tribunals of Hyderabad shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms.

If any dispute arises, it shall first be attempted to be resolved through mutual good faith consultations. If unresolved within 45 days, the dispute shall be resolved by binding arbitration under the Arbitration & Conciliation Act, 1996, by a sole arbitrator appointed by Six Seasons.
